Legal Question in Employment Law in California
Promised 6 months silver parachute--received 9 weeks only
I received a written letter from the President of Company #1 guaranteeing me 6 months pay if that company was sold and my position was terminated due to a consolidation of work forces. In 2001 company #2 purchased company #1. In 2002, my position was terminated due to a consolidation of work forces, and the plant was shut down in March of 2003.
My separation pay from company #2 was only 9 weeks. I was out of work for four months. I retained an attorney and wrote a letter demanding this money. Company #2 refused to honor my claim. They owe me about $17,000. Company #2 is a $30 billion dollar company. I was told that my legal expenses might be so high, that I probably should forget it or sue under small claims court. I do not have enough funds to pay for court costs, etc., due to an expensive court battle. Any advice?

On the facts presented here, you have a case for the unpaid wages. There may also be a possibility of recovering attorney fees, penalites and interest. If interested call me at 805/641-6600 or e-mail me.

if you can email my Law Firm directly with a more detailed account of your situation, as well as more information on the content of the letter that your received from the company regarding your 6 months of pay, we may be able to further assist you legally in this matter. loss of $17,000 is definitely "hard pill" to swallow, so we definitely empathize with your situation. also, let us know what type of legal/court budget you may have to work with if the opposing side remains uncooperative in this matter. this will help us better assess your legal options here. thanks for your question.

I will consider taking your case on contingency. You would pay nothing out of pocket and I would only be paid if we recover. Please fax me the letter from the president. The fax number is 949-266-9968. Please email me with your contact information so I can phone you.
Regards,
Ben
