Legal Question in Employment Law in California

Question regarding: California Labor Code Section 200-243

I was laid off on April 29th, 2005.

I have yet to receive my final weeks pay or my vacation back pay.

I called my HR representative on May 24th to inquire.

She said the check for the final week was mail out May 6th and that I should have already received it. The check for the vacation back pay is still being processed. She indicated the original check would be cancelled and new check re-issued.

What recourse do I have available to me to pursue the ''continuance penalty'' per labor code 203 or any other recourse?

Simply go down to the nearest office of the California Division of Fair Labor Standards Enforcement and fill out a complaint form. You can even go to it's website and download a form, fill it out, then send it in.
