Legal Question in Employment Law in California

Can I quit my job and work in the same area?

Hi!

I have worked at a salon for the last 4 years. I am really unhappy there, and want to leave. When I started, my boss had me sign a contract that said when I left, I couldn't work anywhere within a 10 mile radius for 6 months. I have a large clientele, and want to move to another salon close. I need to know if her contract is binding. Or should I be able to work wherever go? I apprieciate the response.

As a general rule, contracts that say you cannot compete with your former employer are not enforceable in California. You have the right to work wherever you want. You also may send announcements to your clients, telling them where you are now working. It is up to them to decide whether they want to follow you or continue with the old salon.
