Legal Question in Employment Law in California

Race identification of employees

My company sent out an email asking for employees to identify their ethnic group with a checkbox for 5 catyegories: "black, hispanic, asian, american indian or white". The claim is that this is "for mandatory government reporting purposes only".

Is this legal?

Re: Race identification of employees

The company can ask, but you don't have to answer. The US Govt does require some companies to provide this info, but if necessary the company can make a visual survey or look at ethnic last names or the like. The employee's participation is strictly voluntary.
