Legal Question in Employment Law in California

Random Drug Testing

Because I am an airline employee it is required by the government to be ''randomly'' drug and alcohol tested. I work for one of the largest airlines in the world, employing thousands. According to my employer, employee numbers from around the system ''randomly'' show up on a list. Well, my employee number has shown up four times within a year! Kind of like winning the lottery four times. Being struck by lightning four times. It's not possible. They say it's random and I am proof it is not. According to my contract I can be drug tested every month, but this is only if a test has been possitive, which none have. I have never displayed any signs of drug use. The only thing I can think of is they consider my attendance (four sick calls a year) to be a sign. I have a health condition which qualifies me for a Family Leave. I feel as though I am being harrassed. Please Help.

Thank you for your time,

Lisa

Re: Random Drug Testing

Have you spoken to your union rep? I understand your concerns, but I think you may be just a stastical aberration. Consult your union and see if they have any advice for you. I am sorry but the facts as you have outlined them does not constitute discrimination.

Thank you for your inquiry-Martin
