Legal Question in Employment Law in California
Religious or Ethnic Discrimination
The morning after the World Trade Center tragedy a non-practicing Muslim/Arab American Citizen is called into his supervisor's office and informed that his work performance is not up to standards and that the supervisor is unable to account for where he is at certain times and that he seems to disappear and his work is not being completed quick enough. The employee is shocked because just a month earlier he was asked by his supervisor to take over part of a workload for a departing employee because he was doing a great job on his projects. Even through he has an increased workload he manages his projects, even bringing work home with him.Later the same day, he is again brought into his supervisor's office and given a form with which he needs to document his every action in half hour increments. He now feels as if he might be a victim of discrimination in light of the current events , and wishes to know what steps he should take to protect his job or if he is ''laid off'' what steps if any he can take to protect his employment rights as a United States citizen. He is with a startup company and does not have a Human Resource department to go to.
