Legal Question in Employment Law in California

Request for declaration from previous employer

I received a request for a declaration from a previous employer. They say that if I do not comply they will subpoena me. How should I handle this with in mind that anything that I say can be submitted to court later on.

Re: Request for declaration from previous employer

First and foremost, whether you are subpoenaed or sign a declaration, it is under the penalty of perjury, so you will need to tell the truth. By signing a declaration, you may avoid a trip to court which is more time consuming. However, you need to make sure that you read the declaration carefully and do not hesitate to correct it until you are comfortable with the statements. If you feel that there are other legal implications that could be to your detriment, you need to consult with an attorney. If you are in the area, please feel free to contact our office for further consultation.
