Legal Question in Employment Law in California
resign or be fired? wrongful termination?
Yesterday, my boss asked me to resign. I did not submit a grant report and had misled her that I had. I know I made a mistake, but this is the only mistake of this magnitude in my six years of employment. In that same time, I increase private income from $450K in 2003 to almost $750K at the end of the last fiscal year. We are on target to reach the fundraising goal this year. In addition, I have increase the amount of work from the 2 person development office. For the last 18 months, I have asked to add a staff person or else details would start falling through the cracks. Should I resign as asked (with a 2 month lead time and health ins until I find another job) or should I allow them to fire me and file a wrongful termination suit? Or, should I resign, but ask for a larger ''severance'' package?
