Legal Question in Employment Law in California

Resignation

the company policy handbook states the following regarding resignation: ''To resign in good standing, an employee must give an authorized personnel at least 14-calendar days' prior notice. The employee shall supply a written resignation''. Does this leaglly bind to work 2 more weeks? According to the AT WILL law, I can legally resign and walk out the same day.

Re: Resignation

You can always resign. The employer can't force you to work. The issue is whether your resignation will allow you remain "in good standing". Usually, that has to do with consideration for re-employment and future job references. If you don't intend on re-applying this would not be an issue. However, if you are concerned with the employer telling a subsequent employer that you left without suffucient notice, you should comply with the policy and provide the notice period required.
