Resigned June 2009 from job due to company relocating my department 42 miles away. I'm currently attending school, have no car and don't drive, my apartment complex also does not have a parking garage, and also I could not afford paying for the commute expenses or carpool. I've been receiving UI checks since July and my employer appealed to EDD and my hearing is on Nov. Do I have chance at winning the appeal?

Whether you prevail on appeal depends on whether 42 miles would constitute sufficient hardship to justify your resignation. You need to consider why you weren't able to commute to work. I believe you have a chance to prevail on appeal, but you will have to gather the facts and make your case compelling to the judge of the appeals board.
