Legal Question in Employment Law in California

"Resigned" to "Terminated"

Following submitting my two week resignation , and after my last date worked, can the

employer change my status from "resigned" to "terminated"? They also never told me this

until a few days after my last day at the company for reasons of misconduct (unknown

reasons). No reasons were discussed with me prior to my departure. I was an at will

employee. What can I doso this will not affect my next potential employment?

Re:

i dont know to what extent it may or may not affect your next job but if they lie about it you would have good cause to sue them. i suspect they did it to cheat you out of unemployment.

This response assumes you work in California for a California employer. What you describe is an usual business practice. If you care to, you can demand to review your personnel file and insert a response to anything contained within the file to which you disagree (there is no guarantee that your former employer will disclose any statement in disagreement furnished by you for insertion into your personnel file). If your employer refuses to allow you to do the foregoing, you should consult with a local employment law attorney for advice and assistance.
