Legal Question in Employment Law in California

Rest/Meal Period - Falsely Accused

Each employee must sign a timecard that contains a ''perjury'' statement stating that the employee has been given his rest/meal periods.

Recently, a former employee has falsely accused our company of denying him his rest/meal periods.

Will our timecard clause hold up if sued? Please advise.

Sorry for the late response. The message just appeared. You can certainly use it as a defense. However, the employee could say that he was forced by his/her supervisor to falsify his time, etc. So be prepared to have witnesses in your defense.
