Legal Question in Employment Law in California
Retalliation, Wrongful Termination
I worked for a state contracted company that provides assisted independant living services for high functioning mentally disabled individuals. I was suspended then fired for having a non specific inapropriate relationship with a male client recently assigned to me. This was the culmination of two horrific months of thwarting sexual advances which included threats of physical violence, verbal threats of rape, physically groping innapropriate areas of my body, love and hate letters, and delusions that I am his fiance, despite the fact I am married. I have made my superiors aware of this from the very beginning as well as my husband who feels I should file criminal charges for aggrivated sexual battery. Additionally, I have learned from other staff that this client has a long standing history of this type of behavior with female staff, most often resulting in thier termination. Management has responded to me as though unaware this client has ever had such a history and has never acted to resolve my complaints. No longer mentally, emotionally, or physically able to deal with this client management agreed to remove him from my client list after training another Female staffer as my replacement, one week later fired. What can I do?!

Re: Retalliation, Wrongful Termination
It sounds like they fired you in retaliation for demanding a better and safe work environment. You may have a good claim for wrongful termination. I'll be happy to discuss this matter with you, to obtain more information, to give a more concrete answer to you.
