Legal Question in Employment Law in California

Retro pay for raises?

I have recently been given my annual raise. My employer is saying that sometimes paperwork gets delayed or lost and that my increase will become effective once corporate inputs the raise. Shouldnt my raise be effective the date it was given and if so then shouldnt my employer retro me to the start date?

I know of no "right" to a raise unless contractual. He advised of it effective date, date corparate does the input. Maybe you can encourage him or her to followup and make certain it moves as quickly as possible.

If you have done extra work commensurate with the anticipated raise, the simple answer is "probably". However, there's no hard and fast rule, other than that your boss should push the raise along if you're so appreciated. Good luck!

Re: Retro pay for raises?

It all depends on what you were told by your employer. If your employer promised that the raise would be effective on a particular date, you can hold them to that date. If the raise was given subject to corporate processing, and perhaps even corporate approval, you may not be entitled to anything until you see it on your pay stub.
