Legal Question in Employment Law in California
Return of signing bonus after I quit
Last October, I accepted a new job to begin this October (I was in graduate school, hence the long lead time). In the ensuing year, the nature of the job changed greatly. Therefore, when I began this October, I discovered that I had no desire to stay in this job. Unfortunately, when I accepted I was given a sizable signing bonus that I no longer have! I did sign a letter stating that I would return the money if I didn't stay one year. Someone recently told me that, technically, if they took taxes out (treating it as regular wages - which they did) they could not legally ask for it back - regardless of what I signed.
Is there any truth to this?
Thanks -
