Rights of the Interviewee

After an interview and if I am not hired, what rights do I have? I am an employee of a school district and have been here for 17 years. I am trying to move into the position of counselor but continue to be overlooked. What rights do I have? I have the qualifications.

It is not possible to answer your question without more facts. There are lawful reasons for denying a job to an applicant and unlawful ones. Why do you think you were denied the job? If the real reason you were not hired was a reason that is prohibited by law, and you have evidence to prove it, there are steps to take to challenge the decision. But if the school district hired someone more qualified, they did not have to give the position to you.

If you are a classified employee, you should discuss your concerns with your union representative to get some feedback from how the union views your situation. If you think you are being discriminated against, meet with an experienced employment law attorney to review the evidence you have in support of your suspicions.
