Legal Question in Employment Law in California

My Rights?

I am currently working for an employer who unfortunately has burned myself and other employees in the past. This employer wants me to transfer to work in another part of the company that pays almost $3.00 less hourly than were I am working now. I told them I cannot work thier unless I get the same wage. They told me since it was thier request that they would pay me the same. I have talked to others who were in same predicament and they were lied to as usual. Please tell me how I can protect myself so I would not get fired for not transfering but can guarantee that if I do that I will be able to keep my current wage. Thank you. I would appreciate your quick response since I am facing this now.

Re: My Rights?

There is no easy or quick or exact answer to your problem. A company which has a history of lying certainly is not to be trusted. You could write a confirming memo to the person who told you that you would get the same wage, and make sure it is delivered and received, but if the company really wants you out, it will find another reason to dump you. Sounds like it's time to update the resume, check the want ads and contact the headhunters.

Re: My Rights?

Unless you have a contract that covers your position and wage, the employer may make changes with or without your agreement. Such contracts may be implied, however in light of your employer's past conduct it doesn't sound like protection of your position and wages can be implied.
