Legal Question in Employment Law in California

Roundling Policies

My employer rounds up 6 minutes when clocking in and up 15 minutes when clocking out. So if your work hours are 8am-5pm and you clock in at 8:06 they round up to 8:00. If you clock in at 8:07 it just stays 8:07. If you clock out at 5:15 they round up to 5:00, if you clock out at 5:16 it just stays 5:16.

Is this the way it should be done or should the rounding for in and out be the same? Any insite to the rounding polices rules for California will be helpful.

Thank you in advance

Re: Roundling Policies

Rounding is permissible. However, it must be done fairly, both up and down. Thus if you clock in at 8:06, its OK to round to 8:00, (an 8:07 clock in would round to 8:15). But under the same rounding policy, if you clock out at 5:07, it should round to 5:15.

It is possible that your employer's policy is causing an underpayment to some employees. Feel free to contact my office to further explore your potential claims.
