Legal Question in Employment Law in California
Can salaried (8 years) restaurant manager have her hours and pay cut?
1 Answer from Attorneys
Generally, unless the employee has an employment contract that provides otherwise, an employer may cut an employee's pay/hours. (Of course, if the employer does so for an illegal reason, such as the employee's age, race, religion, or in retaliation for the employee's of sexual harassment, etc., then the employee would have a case for discrimination/wrongful demotion.)
However, your question raises a couple of issues, since you mention that you are "salaried," yet you also state that your hours have been cut, implying that you are paid by the hour. Does your employer pay you for overtime? Does your employer provide you with meal periods and rest periods?
You should consult with a California employment lawyer regarding your specific situation to discover whether you may have any claims against your employer and what your options are going forward.
Good luck!
