Legal Question in Employment Law in California

salary contributions

My IRA contributions are withheld from my monthly salary. I recently learned that my employer has delayed in sending those payments to my IRA, sometimes for several (5) months. Are they legally entitled to this delay without notice or consent? Also, are there tax implications (for me or for them)?

File a complaint with the United States Dept. of Labor (not the California Labor Commissioner). They have jurisdiction over 401K violations.
