Legal Question in Employment Law in California

Is Salary required for management?

I was recently promoted and given a ''manger'' title. I now supervise other employees as well as maintain all the duties I previously had. I was told that with the promotion I would be changed over from hourly to salary. I would prefer to keep my new title and responsibilities but stay hourly. Is this possible? What factors may be involved in determining this?

Re: Is Salary required for management?

In order to answer your question, we need more details at to what your job duties are in order to determine if you are properly classified as a salaried employee. What are your "previous" duties, how much time do you spend doing those duties, how much time do you spend "supervising" other employees, what do you do to "supervise" them, do you hire and fire employees? Please see our website for a quick test as to whether you are properly classified as salaried-exempt or feel free to call our office.
