Legal Question in Employment Law in California

sales commission post employment

I am an independent sales contractor for a general contractor in CA. I sell energy efficiency products that the contractor installs. I bring in contracts with deposits then the projects can take up to 6 months or longer to complete. The terms of my agreement indicate that I earn 3% of contract value at contract signing and 10% of gross profit at project completion. I will leave the company soon but have many contracts on the ''books'' in various stages of completion. Will I be entitled to my full commissions when I leave?

Re: sales commission post employment

The terms of your commission contract will, in large part, determine whether you will be entitled to full commissions. It may also depend on how much, if anything, the salesmen needs to do, once the job has been booked. Keep accurate records of your accounts, so if there is a dispute, you will be able to document the validity of your claim.
