Legal Question in Employment Law in California

sales commission

i was sales rep and took order from customer a year ago. i was paid partial commission $25,000 and when my customer informed me that the parts were non-functional, my employer stopped commission of $15,000.00. my customer already paid my employer for all sales. i left the company six months ago, when i ask for commission payment, my employer is asking me to sign (notorized) on an agreement that if the customer file lawsuit, i will have to pay back all commission paid to me. if i refuse to pay back, my employer can go after my personal property. do they have the right to do that? if i sign, can they go after my personal property to recover the commission paid to me? am i entitled to recover the balance commission even this returning products issue still pending? how can i make them pay me? Thank you very much in advance for your advice.

Re: sales commission

It sounds like you did everything necessary to earn the commission. You are entitled to be paid for the balance owed and there is no reason for you to sign the agreement the employer is demanding as a condition of being paid.
