separation agreement and CA labor code

I resigned and gave 3 days notice. I didn't receive my final wages until 9 days later. I still have not received payment for acrued vacation. My separation agreement and release states that I waive my rights under the terms of section 1542 cal. civil code. Does this mean that I cannot file a claim for waiting time penalty related to a violation of cal. labor code 203?
