Legal Question in Employment Law in California

Separation Pay

I was laid off and was offered separation pay, payable to me within 10 days of signing the agreement. Is there an age where they must issue the check to me immediately?

Re: Separation Pay

I am not sure I fully understand your question. Since you were terminated all earned wages & vacation hours are due and payable on the date of termination. Severance agreements are totally different. Severance, generally, unless there is a contract, is discretionary. You must sign the agreement presented by your employer to start receiving the severance pay. Keep the two separate because they are treated differently.

Good Luck!
