Legal Question in Employment Law in California

sexual discrimination

I am a 26 year old female bartender among allmalebartenders fora very wellknown restaurant in California and all over the country. I have currently run into some problems with the malebartenders i work with concerning my job performance. My managers have not repramanded me regarding the issues at hand which at this point are still obsolete and very vague however I am afraid that the the other bartenders are trying to get me fired. They have already taken away one of my shifts and I am afraid it is going to lead to my termination. What are my rights? What Action should I take?

Re: sexual discrimination

Unless you can prove a hostile work enviroment or a quid pro quo-unlikely given your discription-,there is nothing you can do until you are terminated and then you have to prove you were terminated for no good reason except the fact you are a woman which is a high hurdle indeed. If you think you will have a discrimination or harassment claim, you should be keeping copious notes of everything going on and have witnesses. As a practical matter, you should probably be looking for another job if for no other reason than to supplement your income for the shift you lost. Feel free to contact me with any other questions and good luck-Martin
