If a prospective employer shares info with a present employer, it could lead to a defamation action (assuming it is defamatory). Alternatively, it could protect that prospective employer against an action for negligence by the present employer should that present employer sue the prospective employer for some harmful act taken by the employee that could have been prevented had the prospective employer shared the information it had with the present employer.
