Legal Question in Employment Law in California

Short changed on hours

My husband's design job is only paying him for the time spent on the computer- it is automatically figured every time he logs onto a file. He may be in the office 8 hours, but only be paid for the 5 hours (or whatever) that he is on the computer. He was told that this is a full time job. Is this legal? What about break time, etc?

If you husband is an employee, rather than an independent contractor, the employer should pay him for all hours worked, not just for hours he is on the computer. Please feel free to contact me for information on how to file a claim.
