Sick Pay

Can an employer deduct sick pay from your final check when you are terminated stating it was over taken?

As a general rule an employer may not make any deductions from an employee's wages without a written authorization as to the amount and the specicifc pay period. If an employer makes an improper deduction from an employee's final wages, the employer may be required to pay a penalty (the employee's daily wages for as long as the wages remain unpaid, up to 30 days). A claim can be filed with the Division of Labor Standards Enforcement, a California State agency.
