Legal Question in Employment Law in California

"Signing Bonus Pay Back Requirements

Do I have to pay back my $1,000 hiring bonus ALL AT ONCE on the last day of employment with my current employer or can I offer the company monthly payments until it is paid off so I can afford to pay my rent and eat?

(It was used to move into my new apt. with my son and I live paycheck to paycheck. I thought I had to be at the company 90 days to avoid not having to pay it back. They say one year. Assuming they are correct, can I offer payments without expecting a law suit and being forced to give up my car and my apt. to pay them more than $100 per month?)

Re: payback of hiring bonus

Your employer should accept your offer to pay back the bonus over time since it would cost more to sue you than it would be worth. Moreover, by the time your employer could get a judgment, you would have paid off a substantial part of the debt if you make the monthly payments.
