Legal Question in Employment Law in California

slander

An employee told human resources that I ''on purpose'' threw a filled soda can that I was ''pitching'' into the recycle bin at her and soda got into her hair. Of course this is not true. I did pitch the can into the bin, but not at her, and the can was EMPTY. She then told them that the next day after she told that lie that I then ''stared at her'' while walking in the hallway, which also is not true. I didn't pay her any attention, is how it really went down.

what recourse do i have against this woman? she gets to take an instance and turn it into a personal issue? she gets to say i did things to her that i didn't do?

There was an ''investigation'' and the claim of the soda can was supposedly confirmed by two other employees (who are friends of hers) but the claim of the ''starring'' came of nothing. There was nothing to come of it. Who can confirm something like that?

Well in the end, this alleged incident goes into my personel file and could Jeopardize any promotions for me. I have 5 years invested into this company, she has 1 year. Oh and let me not forget to mention-she wears a hearing aid.

I'd appreciate some feedback as soon as humanly possible.

You are entitled to have the company put your written response to the allegations in your personnel file. You should do so, so that whoever should review the file at some later date has a broader understanding for what has happened.
