Legal Question in Employment Law in California

My son works for Trader Joes in Nor. Cal. He was out on worker's comp from tendonitis. Now that he is back to work, his hours have been cut from 20 hours a week to 5 hours a week. We feel that they are trying to make him quit. Instead, he scrambles around weekly picking up hours from other employees who need a day off.

Does he have a case? Can TJs be forced to schedule him his 20 hours? Also, he pays for his own medical insurance through TJs but you must work 20 hours a week to maintain your premiums.

Help? and thanks!

He might be better off if he stays on temporary disability benefits rather than working a few hours a week. He needs to go back to his doctor and request to be taken off work because it seems that modified work is not available. Feel free to call us at 213.388.7070 for a free consultation.
