Legal Question in Employment Law in California
I am starting a new job next monday. I have not given notice to old job, and want to take the rest of my vacation next week. is it legal to do that...meaning...my industry does not require 2 weeks notice...the day you quit is the day you are done. I just want to know if I can ask for vaction next week legally and start the other job and collect obviously 2 paychecks.
Besides the ethical situation is this legal?

You should not start working for a competitor while still employed with your old company. It reeks of a conflict of interest and employees have been sued for doing so, even if you have done nothing to harm the company.
The smart thing to do is to give your notice on the Friday, before starting your new job. Your old employer must pay you all wages earned, including accrued vacation, within 72 hours of the notice.
