Legal Question in Employment Law in California

Taking Forman to court...........

Hello, as always great site ! I work for a gov't company and we are teamsters, and unfortunately my forman is not concidered management therefore protected by teamsters, my problem is that he is so unprofessionial and he likes to single people out and harasses ( by way of verble abuse which humiliates me and he knows it) to much to list ! i have told my superviser and nothing happens! This is what i want to do, i want to sue him in small claims court for ''harassment'' and ''abuse of color of authority''I dont want to file a claim with human resources, i dont need ''fair employment'' tho i know he would get a severe tongue lashing!! just a little rought justice !i figure if i sue him he just might get it the hit!! what are my odds of winning and will the courts get involve in this area, i do have written states from several employees and a few will give there statements in person. Thank you

I'm not sure what a "government company" is, other than perhaps a public utility. Because your claim arose while you were at work, you probably would not prevail in small claims court. Your emotional distress is an issue that likely may only be adjudicated in the workers compensation arena.
