Legal Question in Employment Law in California
Temporary Employment Question
Does a Temporary agency have the legal right to black ball an employee? I am a resident of California, (53 years old, African American female) I just learned that an agency I am working for has my name on a no contact list. The only scenerio I can come up with is that in 1994 (the Year I was given)one of the temp agencies I worked for was dis pleased with my work. They went out of business and another agency took over their cliental. Although I registered with this agency this year, the other agency still has my name stating I am not to be contacted. I was told this by an employee who attempted to send me on an assignment. I called to tell the person that I was referred for the position and he said my name and asked me for my social security number. I gave it to him and he said oh, we filled that position. However, when I called to report this to the referring agency she told me, that was not true that it was that they (more or less) black balled me.

Re: Temporary Employment Question
It is illegal to balckball someone. See CA Labor Code Sect. 1050-1054.
