I was terminated from my job and didn'f receive my final paycheck for over 3 weeks. Can I sue for having to wait for my money

Check with the Labor Board for the State. Find out if the amount you can get is worth the effort -- I doubt it is.

The late penalty is a day's pay for each day they were late (from the day of termination), up to a maximum of 30 days, for willful failure to pay your wages due.

Ignore Mr. Shers. As Mr. Kirschbaum points out, the waiting time penalty for failure to pay wages due upon termination is a days pay for each day waiting. So three weeks adds up to about a month's pay. On top of that, the Dept. of Industrial Relations, Division of Labor Standards Enforcement will enforce those penalties for you, if you have proof of your claim. Go to their website and file a claim.
