Legal Question in Employment Law in California

Am I terminated?

After reurning from 10 days emergency family leave, my employer would not call me back. His wife gave me the very clear impression that he would call to reassign me. I tried daily to reach him for assignment. After two weeks of being lied to, I assumed that i was laid off. I still do not know the reason.

I am the district mgr for this company with 15 years.

I have seen him do this to other employees.

He tends to ''loose '' the paper work for unemployment etc... I am in California.

I have sent hinm a certified letter asking for a letter of unemployment so that I can recoop my lost wages through insurance and so far he has not responded.

Re: Am I terminated?

You don't need anything from the employer to file your unemployment claim - the fact that you have not been scheduled is enough to file.
