The use of time clocks

I work for a post production company in Hollywood with more than 100 employees. There are management personel who are on Salary and those who aren't in a management position that get paid by the hour. Our company has installed a time clock for the employee's. The employee's that are on a salary basis do not have to use the time clock. One would assume then that the time clock was installed to keep track of the employee's who get paid by the hour. Some hourly employee's have to clock in and some do not. Is it legal to delegate who needs to clock in and who doesn't?

The only legal requirement is that they keep accurate records of the time for hourly employees. How they do it is up to them.
