Toxic Torts and SBS/TBS
There is very poor indoor air quality in our building and a number of people have become ill. The company is aware of it but denies it and refuses to do anyting about it because of the cost to fix it. If we decided to file a civil lawsuit what law would we cite as the basis of the lawsuit. Everything I've read or have seen on Toxic Torts relates to ground/water outside types of contamination. If we used Toxic Torts is there a specific part, chapter, title etc that needs to be cited? Since the company has been told many times by many people, is there another law also that could be cited about being knowingly negligent and telling people there is nothing wrong when there is?

This is called tight building syndrome. Many people exhibit Epstein/Barr symptoms. They are lethargic and generally have a sore throat. They also exhibit symptons of a cold. Since building is totally reliant on the HVAC, the filters have to be changes as recommended by the manufacturer. I have yet to see a fatality due to tight building, however, it is in the best interest of everyone to change the filters. The employees will be more productive. The alternative is to seek treatment via Workers Comp.
