Legal Question in Employment Law in California
Travel Reimbursement
Our company provided van pool for more than a year. Now it will be discontinue starting 8/1/03. The question is the driver of the van is also employee of the co. and he did the driving most of the time with a little help now and then with one of the van pooler also employee of our co. Now this main driver is asking for reimbursement for the driving he did for the past year and a month. But he uses the van for his travel time from his house to the meeting place and then to worksite and vise versa. In short he uses the van to be his means of transportation. So is he eligible to be reimburse and how do we calculate how much he will get reimburse if he do have to be paid for his driving service? Thank you so much for spending time to my question I really appreciated whatever ans. you might give me.

Re: Travel Reimbursement
Generally expenses to and from place of employment are not considered travel expenses unless they are negotiated by contract or the driver and the company had some understanding that the service was provided in anticipation of receiving a payment or reimbursement.
