Different treatment of employees

My employer monitors the coming and going of employees by registering their parking card activity and uses these reports for disciplinary actions and performance issues. The monitoring is NOT disclosed to employees when signing up for a parking card.

Employees who don't park, do not get monitored and are therefore treated differently.

What legal actions are available if the reports are used in order to justify a termination?

It is not illegal for employer to monitor the parking and it does not need to be disclosed to the employees.
