Legal Question in Employment Law in California

Unemployment

My Mgr has approached me to add additional roles and oncall hours to my current fulltime duties that will impede and affect my ability to take my current medical treatments for my disease (that has no cure). Can they fire me if I decline or if i'm force to make a decision to quit. Can I collect unemployment in either option (quit/fired) untill I can find another job? I do have Dr's that will vouch for my health & treatment conditions. I feel as if my mgrs are setting me up to fail at a job I've been with for 12yrs at this company. My Mgr knows about my condition but still insist on me taking this job role. Thanks in advance for the help and advice.

Re: Unemployment

If you are in fact fired or forced to quit because you cannot undertake the additional responsibilities due to your condition, then you may have case for various claims such as failure to accommodate, constructive discharge and discrimination on the basis of disability. If your employment situation escalates, consult a labor law attorney in your area.

Best of Luck.
