Legal Question in Employment Law in California

Unfair policies that are not in writing.

I put in for a resignation. I tried to recind it with 2 weeks and a day left until my last day. i was told it was policy that they not recind resignations. i had worked there for 10+ yrs. they offered me to re-apply. losing seniority and my current job position. Basically, starting all over. However, there is a person working there now that was able to recind his resignation and not have to re-apply.

Resignation Policy

When you resigned, you terminated the employment relationship. The terms of any rehire are subject to the employer's discretion.

The above is meant to assist in a general understading of the subject matter. IT IS NOT TO BE REGARDED AS LEGAL ADVICE AND NO ATTORNEY - CLIENT RELATIONSHIP HAS BEEN ESTABLISHED. Companies and individuals with particular questions should seek advice of counsel.
