Legal Question in Employment Law in California

Unlawful Termination

I have worked in this restaurant for five years. We just got a new manager. The first day of working with him-he gave me a hard time. After working with him for three weeks, I got fired. Im a waitress-I had a table that left without paying their bill. He told me to pay $48.00 the amount of their bill. I told him I would not, so he fired me. In the employee handbook there is nothing that addresses this. I have talked to managers who say he was wrong for firing me. Now the company is asking me to come back. Do I have a case?

Take the job back

You may or may not have a case. The real question is, if you do, what is it worth? If you have only been out of work a couple of weeks or so you might have a case worth a few hundred dollars. You might be better off just taking the job back.
