Regarding unpaid payroll

I worked for my former employer until end of February this year. My normal payday was 10th of each month. My former employer asked me to deposit the paycheck on the 10th day of March this year. I was out of town until end of March. I called to let him know i would cash out the paycheck any time soon. He told me there is no funds available in their bank account and told me not to deposit the paycheck and wait little longer. Since my former employer was having bad financial problems, I wanted to make sure there's enought funds in the bank account before i cash out. It's been abount 8 months now. I tried to contact him several times. I even sent him an e-mail. I only get the response to wait. I am out of my patience and can not just forget about my paycheck just like that.

what shall i do now??? I am planning to file a small claim but the business is no longer in its business. (company were suspended in the beginning of this year.) Actually its status with Secretary of State is in active. But there is no actual business going on.

Do as you should have months ago. File a complaint with the Labor Board.
