Legal Question in Employment Law in California

vacation

I start working for this company on 9/1/1998 by 9/1/1999 I will have one year. by then I belive I will be entlied to one week of paid vacation.but according to our general manager we (all the employees)will not. he said that since vacation goes by quarters and we started with the on 9/1/98 we are entiled only from 9/1/98 to 12/1/98 that means about 12 hours of vacation time. is this legal? is he right?. can you informed me more about co. vacation

If you are a California resident, your employer's vacation policy may be suspect. For example, unless the vacation policy specifically states you may not begin to "accrue" vacation until a date later than your date of employment, you may be entitled to assert that the vacation policy allows you to accrue a "pro-rata" vacation benefit during the entire year employed. That is, your vacation benefit started to accrue the moment you began employment. You should read your employee manual and discuss your interpretation with HR.

No employer is required to give any vacation time but if they have a policy they must follow it. The policy can be just about anything they want.
