Legal Question in Employment Law in California

Vendor is suing my wife

My wife worked as a bookkeeper for a concrete company until 2001. The company got sued by a concrete vendor in 2005 but the company won't pay up and has gone out of business. The concrete vendor named my wife as a defendant because she signed the credit application for the company. She was an hourly employee. Just to file an answer to the lawsuit has cost us $650 (may as well be a million). We have yet to hear an answer back. Is she liable for this debt? Can we get our $650 back from the vendor if the lawsuit is frivolous? Thanks.

Re: Vendor is suing my wife

you should be able to get this dismissed with a sharp letter from an attorney threatening them with a malicious prosecution claim. would not be much of a charge. . .
