Legal Question in Employment Law in California
verbal resignation/constructive termination
I got into a heated debate with owner A regarding a project. The owner talked down to me and out of frustration I quit.
The work environment has become oppressive due to a power struggle between owner A and owner B. Owner B has asked me to push his agenda to owner A and put me in harms way. Owner A is addicted to painkillers and has jeopardized my projects and good standing with clients. To date I have been extremely successful.
I immediately asked if we could work things out in an email and admitted regret to saying I quit.
They have cut off my pay and are asking me to negotiate a non-compete. They are simultaneously asking me to continue working of projects but now on commission only.
My wife is eight 1/2 months pregnant and this is causing a tremendous amount of stress on us.
What can I do?
thanks,
b

Re: verbal resignation/constructive termination
Well, if you really want to continue to work there then you may want to consider trying to negotiate with the owners considering your wife's state. As for the non-compete, these written agreements are generally unenforceable in CA. However, there are exceptions to this general rule and you should consult an Attorney before signing one. Good Luck.
