Legal Question in Employment Law in California
violence in the work place
i have a co-worker threatening harm to me at work. i have filed a complaint with my employer. the question now is the dept of human resources is questioning me about having a problem with this person. they are not addressing the real issue. this person has mental issues and has stated that he has guns and one pistol small enough to hide. my employer and the risk management dont feel he is a threat and are looking at me as a instigater of the situation. i have doc's
and witnesses to support me. i need to know my rights if i have any. right now im having problems at home with my wife about this situation. it has disrupted my way of living and has stressed my family to the point where they dont feel safe. i have seen this person within one half mile from my home. all of this was brought to my employers attention but to no avail.

Company should investigate immediately and if such serious charges pending, maybe suspend he/she and/or you till resolved. You should see attorney to discuss further action.
