Legal Question in Employment Law in California
Voluntary opt-out of benefits by older man
I am 55, changing fields, unemployed as of last month, and paying for my own health insurance. Adding me to a group health care policy, or otherwise paying my premiums, would cost an employer more than would doing the same for a younger employee. Is there any way that I can volunteer to maintain my own health care coverage and spare an employer this burden? I don't want to cost an employer more than I contribute to his or her bottom line, and I would rather be working and paying for my own coverage than to be unemployed and paying for my own coverage. Can it be done, or is the whole idea just too dangerous from a legal perspective? Thanks in advance...

You are not required to participate in an employer's health insurance plan. You can opt out and maintain your own insurance. Many people do this. However, it would be unlawful for an employer to discriminate against a job applicant on the assumption it may cost them more.
